Top 12 Questions When Renting
an Apartment in Israel ================================

If you're about to rent an apartment in Israel you're bound to have a few questions about the legal side of things. Below you'll find 12 of the most common questions, together with the answers you need.

  1. How long is a lease usually for?
    That really depends on you and your landlord. Whatever you decide, make sure that the length of the lease is written into the rental contract, together with the start and end dates and the total number of months.

  2. What if I don't know how long I want to rent for?
    If you're not sure how long you will want to rent, you should make sure that the lease includes an option clause that gives the tenant (and only the tenant) the choice to extend the lease for another term or part of a term. An option clause that leaves the decision to both parties i.e. the tenant and the landlord, essentially gives the landlord veto power on whether or not the lease will be renewed and is not recommended.

  3. What if I want to leave the apartment before the lease ends?
    If you may want or need to terminate your lease before the end of the lease period, it would be prudent to add an appropriate clause to the rental agreement. Failing that, you will be liable...

Tip of the Month

If you are purchasing an apartment that you would like to renovate and perhaps build an addition to, you should consult with an engineer or similar professional that can give you information as to the zoning laws for the neighborhood. This is in order to ascertain whether or not you will be able to obtain a building permit for what you want to build. This professional can also explain to you what getting a building permit entails and what it is likely to cost. Don't assume that you can build whatever you want. If you build illegally, the local municipality can require you to get a building permit or even demand you demolish what you've built.

Legal Vocabulary
-------------------------------------------------

'Chachira Ledorot'  – This means a long term lease. Much of the land in Israel (but not all) is owned by the government and administered by a government agency called the Israeli Land Authority (Minhal Mekarkai Yisrael). Instead of getting direct ownership of the land the purchaser gets a long term lease for 49 years or 98 years. The lease is renewed at the end of the period. This does not prevent the purchaser from mortgaging, selling or leasing the property.
